After sending my earlier letter of today enclosing a draft clause

I discussed two aspects of subsection (5)(b) with Clift.

First, he will consider whether the words "or on behalf of" can be

omitted on the footing that appointments by the Secretary of State

and by the Governor acting under the Royal Instructions are all

equally effected by the Crown. In other words the Secretary of

State and the Governor are alike in making such appointments for

the Crown.

Second, he mentioned that the councils he is concerned about have

ex officio as well as appointed members; and we agreed that it would

be better to say "members of which are appointed" rather than "whose

members are appointed" in order to avoid something to require all

members to be appointed.
