BRIEF FOR OFFICIAL TALKS WITH THE HOME OFFICE

1.
Governor's stress on dangers to confidence arising from
Bill. Must accept his advice.
2.
Need for some amendment to Bill to meet Governor's
problems.
3. Two points:
a) Concern of Crown Servants (including Unofficials)-
b) Risk to confidence among population as a whole.
4.
The range of Hong Kong suggestions is as follows:
a) Deletion of words 'under the Government of the United
Kingdom' in Schedule 1, Paragraph 1(3) and Paragraph
1(1)(D)(ii). This would be intended to cover the
situation in which, following naturalisation, those in
Crown Service were required to continue to serve in Hong
Kong in order to provide stability and continuity of
administration.
b) Deletion of 'under the Government of the United
Kingdom' from Schedule 1 Paragraph 1(3) together with
insertion, after sub-paragraph (e) of Paragraph 2,
the following new sub-paragraph (f):
of
'(f) Treat the applicant as fulfilling the
requirements of Paragraph 1(1)(D)(ii) and (3) as
regards Crown Service if he is performing or has
performed any duties or functions for the Government
of the United Kingdom or of any Denendent Territory'.
c) To meet the problems of other CBDTS in Hong-
Kong, a new paragraph to be inserted in Schedule 1:
