The proposed amendment to regulation 61 will also avoid any possible conflict with regulation 99A of the principal regulations. Regulation 99A deals with business or trading operations carried on in schools subject to the prior approval of the Director. This regulation imposes very strict controls on business or trading undertakings and so it is considered that it should be specifically excluded from the ambit of regulation 61. If not, it could be argued that every time there is a variation in the prices of certain articles supplied under regulation 99A such as books, stationery, school uniforms, etc. then any increases should be published in accordance with regulation 61. This clearly would be impractical and not within the intended scope of regulation 61.

Consequent upon the proposed amendment to regulation 61 a minor revision to the wording of the certificate in regulation 67 is required to provide for the approved charges and payments other than the inclusive school fees.

The detailed provisions of the proposed amendments are described in the Explanatory Note to the regulations. The amendments permit the Director of Education to approve charges and payments in addition to those contained in the gazetted school fees. The certificate prescribing certain information is also revised,

The regulations have no financial or staffing implications.

Public Reaction

Some parents may be interested in the proposals, but otherwise there is unlikely to be much interest from either the general public or the news media, Doubts have been expressed by some schools as to what charges and fees may be lawfully demanded and accepted and what may not. These doubts should be resolved by these amendments and so any comment should be favourable.

Publicity

Routine publicity will be arranged by the Director of Information Services and schools will be notified of the amendments through Schools General Circulars.
