List of points to be incorporated in the proposed new ordinance to replace the Hong Kong Baptist College Board of Governors Incorporation Ordinance (CAP. 1126)

(a)

Annex E

The College to be exempt from the Education Ordinance and the Post-Secondary Colleges Ordinance.

(b) HE to be the Visitor to the College and, in his absence,

the Governor's Deputy or Acting Governor will exercise any rights and duties of the Visitor.

(c) The Visitor shall not be an officer of the College

but shall appoint certain of the officers of the College. In addition, appeals from staff and students shall lie to the Visitor for redress of grievances.

(d) The Board of Governors will remain the supreme governing

body, but the Council will have all necessary executive and administrative power. (This relationship would be

similar to that of the Court and the Council of the University of Hong Kong).

(e) The present membership of the Board of Governors will remain, including the right of the Baptist Convention to elect 18 members thereto (six each year for a 3-year term), but in future members of the Council shall automatically become members of the Board as well.

(f) The Chairman and Vice-Chairman of the Council (and

possibly the Treasurer) shall be appointed by the Visitor from amongst present and former members of the Board of Governors.

(g) In addition to its present membership the Council shall

have 5 members appointed by the Visitor.

(h) Subject to such directions as may be given by the

Governor-in-Council, the College shall have power to mako academic awards.

(i) The Governor-in-Council shall also have general powers

of direction over the College.

(j) In the event of the winding-up or dissolution of the

College all recurrent and capital grants and subsidies from the Government would be a first charge on its assets.

(k) The Constitution of the Baptist College shall be redrafted

as Articles and shall be a schedule to the new Ordinance.
