Introduction
In paragraph 11 of memorandum XCC(81)46 which has already been circulated to Members for discussion on 5th May 1981, it was stated that urgent consideration was being given to a scheme to prevent Vietnamese refugees from working. This consideration has been completed and the Immigration (Amendment) Bill 1981 at Annex A to the previous memorandum has now been amended. The amended version is at Annex A to this memorandum for Members' consideration. The amendments seek to provide measures to enforce the prohibition from taking employment by Vietnamese refugees should it be decided to introduce a condition of stay that they should not be permitted work at some future date. The amendments are contained in new section 13A(3)(b) in clause 3 and in clauses 4-7 of the revised Bill in Annex A to this memorandum and are sidelined for convenience.

The main amendments to the Bill are as follows:
A Vietnamese refugee will no longer be "lawfully employable" if his Vietnamese refugee card carries an endorsement prohibiting him from taking employment. Under existing section 171 an
employer who employs someone who is not "lawfully employable" is liable to a fine of $50,000 and to imprisonment for one year. (The endorsed Vietnamese refugee card will continue to be an approved document for the purpose of compulsory carriage of proof of identity at all times. necessary for satisfactory implementation of Operation Champion).

An employer will be required to inspect the refugee card of the Vietnamese refugees in his employment every time he pays wages to them. This procedure is necessary so that the employer can ensure that the Vietnamese refugees are still "lawfully employable.
