MASS TRANSIT RAILWAY (LAND RESUMPTION AND RELATED PROVISIONS) (AMENDMENT) BILL 1981

Background
The Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Chapter 276) was enacted in 1974 and incorporated in one enactment:
(a) the statutory powers required to facilitate the building
of the Mass Transit Railways, including the power to resume land and create easements; and
(b) provision for compensating for loss or damage arising
from the exercise of these powers.
This Ordinance provides for all matters pertaining to land affected by the construction of the Mass Transit Railway and, indeed, experience to date has shown that it has enabled quick action to be taken on land acquisition and related problems and in respect of compensation claims arising from the construction of the modified initial system and its extension to Tsuen Wan.

The Mass Transit Railway (Land Resumption and Related Provisions (Amendment) Bill 1981, a copy of which is at Annex, seeks to amend the principal Ordinance by extending its application to the proposed Island Line.
The Island Line

In December 1980 following consideration of memoranda XCC(80)137 and XCC(80)141 Members advised and the Governor ordered that construction of the Island Line should proceed. In accordance with this decision the attached bill seeks to geographically enlarge the scope of the appropriate sections of the principal Ordinance by including stages 5 and 8 of the Railway, that is, the section that runs from Central District eastwards to Chai Wan. The effect of deleting, in clause 2, Tung Loi Lane in Western District and its substitution by Sutherland Street in Western District, is to bring a small portion of what is described as stage 9 within the definition of stages 1 to 6 and stage 8. The opportunity is also being taken appropriately to amend the definition of "Railway" to include proposed extensions..
