Law Draftsman is drafting compensation clauses, and also re-drafting other clauses to clarify the meaning of "best practicable means" and to define those existing users of specified processes which will not be exempted from licensing upon declaration of a specified process. The Authority's discretionary powers to cancel and vary licences are being re-considered in view of the implications this may have on liabilities for compensation. The draft ExCo paper will be modified to reflect these new provisions.
Preliminary draft of Bill received from Law Draftsman and circulated to principal departments for their comments. These have been received and are being considered by the EPA.
