1. I have been asked to send you a brief background note about staffing in dependent territories. The following applies to posts other than that of Governor, e.g. Chief Secretary, Financial Secretary, Attorney-General etc.

Each dependent territory has its own Civil Service. The structure of the service, number of posts, salary levels, conditions of service are laid down in the local estimates, Civil Service Instructions and local laws. The salaries and terms of service in each dependent territory differ according to local circumstances.
3. Formerly most of the senior posts were held on a career basis by members of Her Majesty's Overseas Civil Service (HMOCS). With the independence of many countries, recruitment to HMOCS has ceased except in Hong Kong. Recruitment in the small territories is now mainly of experienced ex-HMOCS officers who go out on a short term contract for 2-3 years at a time.
4. Recruitment is by HKGD (in respect of top Administrative, Legal and Judicial officers), or ODA (mostly professional officers) or Crown Agents (technical, secretarial). Recruitment is on behalf of the territory and the salary is that provided in the conditions set out by the territory and paid by them; local tax, if any, is payable and the officer, whilst outside the UK, is not subject to UK tax. The contract is between the officer and the overseas Government.
5. In some of the poorer dependent territories, the local salary and conditions of service are inadequate to attract an expatriate officer from the UK. The Overseas Development Administration (ODA) under the Overseas Service Aid Scheme signs an agreement with the dependent territory concerned to "top up" the salary of certain expatriate officers serving in senior posts, pay appointment, termination of appointment, holiday visit, leave and medical passages, as well as education allowances. The "topping up" of salary is tax free and is calculated so that local net salary in the territory plus topping up equates to the net take home pay of a UK equivalent post plus FSA, a superannuation element and an inducement allowance.
