It is considered that the law should allow the Commission to investigate a blackmail offence reported in circumstances where it is apparent that the opportunity to commit the blackmail arose by virtue of a public office held by the suspect. The Commission will not unnecessarily retain for investigation offences which should be passed to the Police Force, particularly if the complainant has no objection to its being passed, but an amendment to the law is required to allow the Commission to exercise its discretion. Clause 2(a) therefore provides a duly authorised Commission investigating officer, with a power of arrest under section 10(1) in respect of a blackmail offence committed by or through the misuse of office, and will allow him to investigate and charge in respect of this offence. The Commissioner of Police has been consulted and has no objection to this amendment
