the addition of 900 names to the Schedule would make

a mockery of the purpose of the Schedule and could give rise to the demand that every Government aided organisation should be added to the Schedule;

should there be a particular need for the

Corruption Prevention Department to examine

particular procedure in one or more aided schools, arrangements can be made for the Independent Commission Against Corruption to be invited to make such an examination.

The Commissioner of the Independent Commission Against Corruption has consulted the Board of Education who have accepted his advice that Government aided schools should not be made 'public bodies".

Blackmail committed by or through misuse of office

Blackmail is an offence which is normally within the purview of the Police Force. It only comes within the scope of the Commission, when, in accordance with section 10(2) of the Independent Commission Against Corruption Ordinance, the Commission is investigating a suspected offence under the Prevention of Bribery Ordinance, and the offence of blackmail is then disclosed. The Commission investigating officer at this stage still has a power of arrest through the interaction of sections 10(2) and 10(5) of the Independent Commission Against Corruption Ordinance, and the Commission officer may continue to deal with the offence, if this is justified in the circumstances. However, if, at the time of the first report, it is obvious that the offence is one of blackmail, then the Commission must hand over the enquiry to the Police Force although this may be expressly against the wishes of the complainant. He may have consciously decided to make the report to the Commission in preference to the Police, particularly if the public servant against whom he is making the complaint is also a police officer.
