Annex A- the Immigration (Amendment) Bill 1980;
Annex B- the Immigration (Amendment) (No 2) Regulations 1980; and Annex C- the Immigration Service (Amendment) Bill 1980.

The amendments proposed in this draft legislation seek to improve, simplify and streamline some of the administrative procedures contained in the Immigration Ordinance and Regulations and in the Immigration Service Ordinance. Details are set out in the Explanatory Memoranda attached to the Bills and the draft Regulations. Additional information on the main recommendations is set out below.
Vesting of Statutory Powers in Immigration Assistants and Senior Immigration Assistants

There has been a rapid expansion of the Immigration Service in recent years mainly to cope with the sharp increases in immigration from China and travel by Hong Kong residents. As a result of this expansion, it was considered necessary to review the work of the depart- ment and the levels at which it is performed. This review has revealed that some of the duties presently undertaken by Assistant Immigration Officers and Immigration Officers could be delegated to the subordinate ranks of Immigration Assistant and Senior Immigration Assistant (referred to in the Immigration Ordinance collectively as "Immigration Assistants").

In order to give effect to the proposed delegations of authority, clauses 8 and 10 of the Immigration (Amendment) Bill 1980, at Annex A, and the Schedule to the Bill seek to provide Immigration Assistants and Senior Immigration Assistants with certain statutory powers. A list of these powers is given at Annex D.
