We have been consulted by Mr. Bruce Porter Baron, United States citizen and holder of American Passport No. G2370814 in connection with the letter he received from a Mr. K.W. Lee on behalf of the Director of Immigration dated 8th August informing him that his application for change of status submitted on 12th February, 1980 had been refused and that he was only permitted to remain in Hong Kong up to 22nd August.

We understand that Mr. Baron arrived in Hong Kong on 11th February, 1980 and was permitted to remain on tourist visa status, although he did not actually have a visa stamped in his passport. Upon his arrival, he explained to the Immigration officer at Kai Tak that he had been granted a class A visa as long ago as 22nd July, 1963 which he had successfully transferred from his original passport to two others when those passports expired and he indicated that he would be applying to have the visa transferred to his current passport. As you are aware, such application was lodged with the Immigration Department on 12th February. Some 6 months later, his application was refused and we now appeal to you on behalf of Mr. Baron pursuant to Section 53(2)(b) of the Immigration Ordinance, Cap. 115.

Our client was born in New York on 15th November, 1949 and together with his parents moved to Hong Kong in September, 1961 on the appointment of his father as Project Manager in connection with the construction of the Hilton Hotel. His parents, himself and his sister duly became residents of Hong Kong and were granted class A status.

Our client received much of his education in Hong Kong, attending initially the first and second forms at King George V School in Kowloon and
