Dear Sir,

His Excellency the Governor has authorised me to reply to your letter dated 20th November, 1980 concerning the procedure for considering the cases of individual illegal immigrants from Macau.

2.

As regards your first, second, and third queries, it is impossible to define fixed criteria for considering individual cases.

Each casG will be examined on its individual merits and taking into account all the factors listed.

As to the possibility of an illegal immigrant being detained at the time of his applying for registration, it has since 30th October been compulsory for all Hong Kong residents to carry proof of identity at all timea. Special arrangements were made between 27th and 30th October for illegal immigrants from places other than China who had not previously registered for identity cards to corne forward and seek to regularise their position by applying for registration. Detention upon registration would have been effected only in cases where the person was the subject of a previous removal or deportation order, or was believed to have committed any other kind of serious offence. This does not mean that upon subsequent investigation- removal will not be effected in individual ces but as I have said in my previous letter each case will be examined compassionately and on its merits. However, the special arrangements to allow illegal immigrants to apply for registration ceased with effect from 30th October, 1980, and thereafter any illegal immigrant who did not then seek to register has become liable to arrest and possible repatriation.
