IMMIGRATION ORDINANCE
(Chapter 115)
IMMIGRATION (AMENDMENT) (NO. 3) REGULATIONS 1980
Made by the Governor in Council under section 59
1.
These regulations may be cited as the Immigration (Amendment) Citation. (No. 3) Regulations 1980.
2.
Regulation 3 of the principal regulations is amended—
(a) by deleting "travel" in the marginal note;
(b) by inserting after "prescribed fee" the following-
"if any"; and
(c) by inserting after "re-entry permits" the following-

The principal regulations are amended by adding after regulation Addition of 9 the following--
"Practice and procedure on appeals to the Tribunal.
Third Schedule.
9A. (1) The practice and procedure on an appeal to the Tribunal under section 53A of the Ordinance shall, subject to paragraph (2), be such as this chief adjudicator may determine.
(2) The Third Schedule shall have effect for the purpose of regulating appeals to the Tribunal.".

4. The principal regulations are amended by adding after the Second Addition of Schedule the following Schedule-

"THIRD SCHEDULE

1. The Director of Immigration shall cause every notice of appeal Duty of to be delivered to the chief adjudicator, or any adjudicator nominated by the chief adjudicator as soon as is practicable.

2. The Tribunal shall deal with an appeal as expeditiously as is Expediting practicable, and for that purpose may sit at any time.
3. (1) Subject to sub-paragraphs (2) and (3), an appeal to the Tribunal shall be heard and determined by 2 adjudicators sitting together. (2) The Tribunal shall allow an appeal if either adjudicator hearing the appeal considers that the appeal should be allowed under section_53D(1) of the Ordinance.
(3) The power under section 53C of the Ordinance to dismiss an appeal without a hearing shall be exercised by 2 adjudicators who need not consider the appeal together, but each of whom shall record his decision in writing.
4. An appeal shall be heard in private:
