Please refer to my telegram 286 of 15 October about the effect of "Champion" on Tegal immigrants. I undertook to write to you separately on the question of private travellers on Chinese passports in transit to third countries.

At present, when these travellers arrive at Lo Wu they will normally (in 90% of the cases) be landed in Hong Kong in transit. This is usually for a period of 48 hours but sometimes a longer period will be allowed where this will be required before the traveller can continue his journey.

If a visa has not already been obtained, one is issued at Lo Wu. (In the past we have usually waived the issue of visas on arrival and permitted transit passengers to enter without visas because of the pressure of work at Lo Wu. However, as this is not compatible with Hong Kong Immigration law, and is also undesirable on other grounds, we have discontinued the practice).

As you know, in a minority of cases (presently about 10%) the Immigration Officer at Lo Wu finds that there is a real danger that the transit passenger intends to remain in Hong Kong if he gets the chance. In these circumstances the passenger is refused landing but is allowed to leave for his onward destination from the Airport. Unfortunately this is usually after a period of detention while arrangements for onward travel are completed. In spite of these measures, we still find that a significant number of transit passengers who are landed in Hong Kong do not, in fact, leave. They either stay on illegally or, more often, apply for extensions of stay. These are normally granted and when the passenger has been here for six months, he
