The Immigration (Amendment) (No.2) Bill: 1980 is being enacted. today and will be published as an Ordinance in the Government Gazette: tomorrow (Friday, 24th October 1980). It introduces amendments to the Immigration Ordinance, Cap.115, including the addition of a new Part IVB which prohibits the employment of any person who is not "lawfully employable", i.e. who is not the holder of a Hong Kong identity card or, in the case of a person exempt from the provisions of the Registration "of Persons Ordinance, a valid travel document, a police warrant card, a

Vietnamese refugee card or a certificate exempting the holder from registering under that Ordinance by reason of old age, blindness or.. 1 infirmity. From 28th October 1980, it will be an offence to take into employment any new employee without inspecting the document which renders him lawfully employable. From 3rd November 1980, it will be an offence for an employer to retain in his employment a person who is not lawfully employable.

The new Part IVB of the Immigration Ordinance also requires an employer in Hong Kong to inspect, and keep a record of, the proof of 24 identity of every employee as follows -

(a) where the employee is required to be registered

under the Registration of Persons Ordinance, the employee's identity card; or

(b) where the employee is not required to be registered

under the Registration of Persons Ordinance

(i) a valid travel document;

(ii) a police warrant card;

(iii) a Vietnamese refugee card; or
