REGULATIONS 1980

Introduction

At the meeting of the Executive Council on 13th May 1980, the Council advised and the Governor ordered that contingency plans should be prepared to provide that all illegal immigrants from China arriving after a public announcement to be made on a date to be decided by the Council I should be returned and should be denied registration or employment.

Further, legislation to implement these plans should be drafted for consideration by Members at a subsequent ineeting.

The purpose of this paper is to set out the contingency plans and draft legislation and consider the question of timing. It should be read in conjunction with the previous paper on this subject (XCS (80)2), a copy of which appears as Annex A.

The Basic Plan

The objective is to add a powerful deterrent to would-be illegal immigrants by bringing to an end the concession whereby illegal immigrants who reach base ("evaders") are allowed to remain and are issued with identity cards. With the implementation of the plan, all the provisions of the Immigration Ordinance Cap. 115 (which allow for the removal of all illegal immigrants) would for the first time be fully enforced in respect of illegal immigrants from China, as a result of which detected evaders would be returned to that country. They would no longer be issued with identity cards under the Registration of Persons Ordinance Cap. 177.
