Registration of Persons Ordinance, of a valid travel

document, a police warrant card, a Vietnamese refugee card

or a certificate exempting the holder from registering

under that Ordinance by reason of old age, blindness or

infirmity.

New section 17I(1) prohibits the employment of

persons who are not lawfully employable" as defined in new

section 17G(2). Since some employees will for legitimate

reasons be absent from work at the time new section 17I

comes into effect, and employers of such persons will not

have had the opportunity to determine whether they are

lawfully employable, a defence is given by new section

171(2).

New section 17H(1) contains transitional

provisions whose object is to enable employers to establish

whether their existing employees are lawfully employable

This new and, if they are not, to dismiss them summarily. section provides in subsection (2)(b) and (4)(b) for an

extended period in which employers and employees may

establish whether existing exmployees who are absent from

work when new Part IVB becomes operative, are lawfully

employable.

Subsection (3) will permit employees who have

lost certain documents to establish that they are lawfully

employable, by producing a document from the Director of

Immigration acknowledging, in effect, that that is so.

New section 17J requires all employers to

inspect the documents of prospective employees before

taking them on as employees. The sanction is the same as

that provided for in new section 171, namely, a fine of

50,000 and imprisonment for 1 year.
