7.61.

The secretary of State is to have a discretionary power to register any minor as a citizen of the BDT.

7.62

Any minor should be entitled to registration by the Secretar of State as a citizen of the EDT if

(a), both parents of the minor were at the time of the minor's

birth citizens of the BDT otherwise than by reason of

birth in a dependency;

and

(b) the minor has resided in a dependency for at least 3 . years immediately preceding the application; and

(c) both parents or, if the marriage has been terminated or one of them as died, a parent, have resided in that dependency for at least 3 years immediately preceding the application.

The term "resided" is used here in the sense ctlined in the

appendix to these Instructions.

Under secticz 6(1) of the 1948 Act all Commonwealth citizens, itizens of Eire ani (via Schedule 3, para 2) British subjects

ithout citizenship are a right to registration as citizens of

he United Kingdom - Coloniec. The Immigration Act 1971

encaled section 6(1) but preserved the entitlement where the

ecretary of State is ratisfied that certain residential require-

ents are met.
