Clause 4 amends the Third Schedule to the
principal Ordinance by deleting the designation of
Authorities for the purposes of section 104A. Such
designation is effected in the Bill by proposed new
section 104E(1).

Clause 5 amends the Ninth Schedule to the
principal Ordinance by specifying the penalties for
the offences under sections 104A and 1043. The penalties
will be a fine of $2,000 and a daily penalty of $50.

Clause 6 of the Bill makes a consequential
amendment to the Summary Offences Ordinance.

It is estimated that the enforcement of
this Bill, if enacted, will require additional staff
and other charges costing approximately $2 million
a year. In the first year of operation, there will
be capital expenditure costing approximately
$0.5 million.
