Explanatory Memorandum
The purpose of this Bill is to amend the
Public Health and Urban Services Ordinance so as to
strengthen the controls over bill-posting.

Clause 2 of the Bill replaces section 104A
of the principal Ordinance with a new provision which
prohibits the display or affixing of any bill or
poster on private or Crown land without written
permission.

Clause 3 of the Bill adds four new sections
Their effect is as
to the principal Ordinance.

(a) Proposed new section 104B This section will
impose on the person displaying a bill or
poster a duty to maintain it in a clean and
tidy condition to the reasonable satisfaction
of the Authority;
(b)
Proposed new section 104C This section will
give the Authority the power to remove bills
or posters which are displayed without
permission or which are not being maintained
in a clean and tidy condition. The Authority
may recover the cost of removal from the
person displaying the bill or poster. Where
a person is convicted of an offence under
104A or 104B, the court may order that person
to pay, in addition to any fine, the cost
of removing the bill or poster.
