may order that person to pay, in addition to any fine, the cost of removing the bill or poster.
(c) Proposed new section 104D Subsection (1) provides that

an offence under section 104A (displaying or affixing a poster without permission) is committed then not only is the bill poster liable for that offence but also the person using him to display or affix the bill or poster, and the person whose goods, trade, business or other concerns are given publicity by the bill or poster. Subsection (2) provides that a person is deemed to display a bill or poster for the purposes of sections 104B and 104C if it is displayed on land of which he is the owner or occupier or if the bill or poster gives publicity of his goods, trade, business or other concerns. However, a person will not be guilty of an offence under section 104A or section 104B or liable to the cost of removal under section 104C if he can prove that the bill or poster was displayed or affixed without his knowledge or consent. (d) Proposed new section_104E Subsection (1) defines "Authority" so as to include those Government departments and public bodies that have the management and control of particular areas of land. Subsections (2), (3) and (4) define "land", "occupier" and "bill or poster". A saving for other enactments is contained in subsection (5).

Clause 4 amends the Third Schedule to the principal Ordinance by deleting the designation of Authorities for the purposes of section 104A. Such designation is effected in the Bill by proposed new section 104E(1).
5. Clause 5 amends the Ninth Schedule to the principal Ordinance by specifying the penalties for the offences under sections 104A and 104B. The penalties will be a fine of $2,000 and a daily penalty of $50.
6. Clause 6 of the Bill makes a consequential amendment to the Summary Offences Ordinance.
7. It is estimated that the enforcement of this Bill, if enacted, will require additional staff and other charges costing approximately $2 million a year. In the first year of operation, there will be capital expenditure costing approximately $0.5 million.
