Explanatory Memorandum

The scope and purposes of the Employment

Ordinance (Cap. 57) is, inter alia, to regulate general

conditions of employment. Regulations made under the

Factories and Industrial Undertakings Ordinance (Cap. 59)

presently regulate the general conditions of employment

of women and young persons. This leads to overlapping

objectives between the two pieces of legislation.

so that the Employment Ordinance will deal with all

measures of a social nature relating to employment

leaving the Factories and Industrial Undertakings

As part of the exercise to provide for the

objects outlined above, clauses 4 and 5 of this Bill

amend the Factories and Industrial Undertakings

Ordinance and Regulations to remove the provisions

therein relating the general conditions of employment

of women and young persons, most of which are contained

in Part II of those regulations. It is proposed to

replace these provisions by similar regulations to be

made under the Employment Ordinance.

Opportunity is taken in clause 2 to remove

the references to the employment of children in section

2(3) and (4) of the principal Ordinance; and in clause

4 to delete section 7(2A) which refers to the employment

of women and young persons. These matters will be now

dealt with under the Employment Ordinance.
