LEGAL REPORT

THE APPRENTICESHIP (AMENDMENT) ORDINANCE 1980

(No. 43 of 1980)

Enclosure No. 2

This Ordinance makes several amendments to the Apprenticeship ordinance found necessary after 4 years of operation.

2. section 2 provides that technical institutions shall give preference to registered apprentices who are required by attendance orders to enter courses at institutions over persons who are not registered apprentices.

3. Section 3 extends the option for the registration of contracts of apprenticeship that do not have to be registered so that an older apprentice in a designated trade and any apprentice in a non-designated trade may register his apprenticeship provided it is in a suitable form and so gain the benefits of registration.

4. section 4 enables the Commissioner for Labour to shorten the period of notice required to terminate a contract of apprenticeship where he is of the opinion that a shorter period of notice would be beneficial to the apprentice.

5. Section 5 amends section 31 of the principal Ordinance to remove an anomaly so that the sanctions applicable to a registered apprentice who repudiates his contract or is dismissed for misconduct apply to all registered apprentices and not only to those apprentices working in designated trades.

6. Section 6 includes parts of the Employment Ordinance (Cap. 57) that are relevant to apprenticeship contracts.

7.

Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
