If in implementing the arrangements set out in this letter ASWE releases the Hong Kong Government any information which belongs to a third party and in which rights exist and ASWE identifies such information at the time of release, the Hong Kong Government will treat such information as commercially confidential by according to it the same degree of protection as it accords to its own equivalent information, will use it solely in accordance with the condi- tions of release, and will negotiate terms with the said third party if use be- yond that allowed by the conditions of release is required.
9. In the event of legal or other action being brought by third parties in an attempt to prevent or delay ASWE from carrying out the schedule of work as set out in paragraph 1, the Hong Kong Government will use its best endeavours, including any statutory or other powers which it may possess, to prevent such action.
10. If the foregoing proposals are acceptable to you, I suggest that your reply to that effect will place on record (the understanding of the United Kingdom Government and the Government of Hong Kong in this matter). (our mutual understanding of this matter). On receipt of a reply accepting the provisions of this letter, arrangements will be made for the work to be carried out.
