With regard to clause 1 (c) hereof, the Commiccioner
considers, pursuant to section 19 of the Ordinance, that
it is necessary for KIP to provide additional floor space
in premises for the purpose of construction, repair and
maintenance of its vehicles used in connection with its
franchise in order to operate a proper and efficient
public omnibus service, and KMB agree that additional
space is necessary. Therefore, in order to assist KIB
to comply with clause 1 (c), the Commissioner agrees
to use his best endeavours to ensure that adequate land
is made available by Government to KB both on a temporary
and a permanent basis at such sites as he considers
suitable for the purpose. In particular, the Commissioner
will use his best endeavours to assist KMB in obtaining
from the Government the land specified in the 4th Schedule
hereto and such temporary parking sites as may be required
to house the fleet with security prior to depot sites
being made available. The Government will use its best

including Ngau Chi Wan and a site in the Lai Chi Kok area
are made available in a timely manner. Upon land being
offered to KMB, KMB shall accept the same upon terms to
be agreed in the light of the private treaty grant
restrictive user terms or short term tenancy terms (as
appropriate) then prevailing in respect of such land
and shall forthwith proceed with the development thereof
for the purposes specified in this clause. The 4th
Schedule shall be reviewed by KB and the Commissioner
from time to time.
