Explanatory Memorandum
The object of this Bill is to increase the powers of the courts unde section 29 of the principal Ordinance to deal with owners and persons in charge of vehicles who withhold information as to the identity of a driver who is suspected of an offence.
By new subsection (5A) of section 29, the withholding of such informa- tion is made punishable with disqualification from holding a driving licence to the same extent as the commission of the suspected offence.
In fixing sentence the court is required, by new subsection (5A)(b), to take account of the facts of the reported offence. Further, the court is empowered to order the offender to disclose the information previously requested by the police, on pain of a continuing daily penalty and imprisonment as prescribed by new subsection (5B).

本法案之目的,在增加原有條例第二十九條賦予法庭之權力,以處理車主或車 輛負責人將涉嫌違例司機身份隱瞞之情事。
根據原有條例第二十九條之新訂第(5A)款,凡隱瞞該等資料者,可被判吊 銷駕駛執照,一如其本人犯有該涉嫌違例事項然。
根據新訂第(5A)款(b)段,法庭判處刑罰時,須考慮所舉報違例事項 之實情。法庭並有權命令違例者提供警方前此要求透露之資料,否則可根據新訂第
(5B)款之規定判處連續性按日罰款及監禁。
本法案對政府經費及人手需求方面,並無影響。
