LIMITATION OF PUBLIC LIGHT BUSES

On 21st May 1976, by Gazette Notice No. 1065/76, the Commissioner for Transport, under the powers conferre don him by regulation 18B(1), now revoked, of the Road Traffic (Registration and Licensing of Vehicles) Regulations, imposed a limit of 4, 350 on the total number of motor vehicles which may be registered and licensed as public light buses. This limit was imposed in accordance with the Government's policy to restrict the public light bus fleet to the number of vehicles then licensed,

At the recent hearing of an appeal to the Court of Appeal, one of the judges touched on the question of whether the effect of the Gazette Notice had survived the revocation of regulation 18B(1) of the Road Traffic (Registration and Licensing of Vehicles) Regulations, but did not in the event express any view. Legal advice is that it would be prudent to re- impose the limitation of 4, 350 under section 7E of the Road Traffic Ordinance (Chapter 220) which came into operation on 1st October 1979.

Section 7E(1) and (2) of the Road Traffic Ordinance (Chapter 220) provides that the Governor-in-Council may, by notice in the Gazette, limit the number of any class or description of vehicle, and that such limit shall remain in force for such period not exceeding six months as shall be specified in the notice. Section 7E(3) further provides that a limit, set as above, may be extended by resolution of the Legislative Council.

Consultation with the Transport Advisory Committee

At its meeting on 29th July 1980, the Transport Advisory Committee endorsed the proposal in paragraph 2 above.

Public Reaction

With the exception of PLB operators and drivers, there will be little public interest in the reimposition of the 1976 limit of 4, 350 on the total number of motor vehicles which may be registered and licensed as public light buses.
