INCREASE IN TOWING AND STORAGE CHARGES FOR ILLEGALLY PARKED VEHICLES

Introduction

Police enforcement action against illegally parked vehicles is normally effected by the issue of "parking tickets" under the relevant provisions of the Fixed Penalty (Traffic Contraventions) Ordinance (Chapter 237). However, Regulation 7 of the Road Traffic (Parking and Waiting) Regulations provides, in effect, that a vehicle may be removed and towed by the Police to a vehicle pound if it is parked illegally. Regulation 161 of the Road Traffic (Construction and Use) Regulations provides that similar action may be taken in cases where broken down vehicles are not removed from the street within a reasonable period of time, or are situated in a place that is dangerous to other road users. When a vehicle is removed under these circumstances, the owner currently has to pay a towing charge of $80, and a storage charge of $20 per day for each day, after the second day, that the vehicle remains in a vehicle pound. The principle governing the level of the towing and storage charges levied under the Road Traffic (Construction and Use) and Road Traffic (Parking and Waiting) Regulations is to recover the actual cost of the tow and storage in terms of manpower, equipment, fuel, etc.. The present fees which were set in 1974 no longer reflect the full costs involved. It is therefore proposed, based on a review by the Police and the Manage- ment Accounting Services Division of the Treasury, to increase the towing charge from $80 to $110, and the storage charge from $20 to $35 for each day that a charge is applicable.
