IMPORT (RADIATION) (PROHIBITION) (AMENDMENT) REGULATIONS 1980

Annexed for the consideration of Members are the Import (Radiation)(Prohibition)(Amendment) Regulations 1980.

The Radiation Ordinance (Chapter 303) provides, inter alia, for the control, manufacture and use of radioactive substances and irradiating apparatus. Dealers in and manufacturers of such products are required to be registered with the Radiation Board, which is the statutory authority for administering the Ordinance. The Ordinance provides that no person shall, without a licence issued by the Radiation Board, manufacture, possess ordeal in any radioactive substance.

In addition, the Import (Radiation) (Prohibition) Regulations control the import of radioactive substances by requiring the import of such substances to be licensed by the Director of Trade, Industry and Customs. In practice, the list of substances and products prohibited, as detailed in the Schedule to the Regulations, is adopted on the advice of the Radiation Board. The Director of Trade, Industry and Customs acts as the agent of the Radiation Board in so far as the control of the import of pro- hibited radioactive substance is concerned.

The Radiation Board has advised that the Schedule to the Import (Radiation)(Prohibition) Regulations is incomplete. As a result, some radioactive articles have been imported into Hong Kong which should be covered by a Radioactive Substances Licence under the Radiation Ordinance, but are not. To remedy this situation the Board has recommended the addition of a number of radionuclides to the Schedule to the Import (Radiation) (Prohibition) Regulations.

The Import (Radiation)(Prohibition) (Amendment) Regulations 1980 amend the principal Regulations by inserting 23 additional elements, there- by subjecting their radioactive isotopes to import licensing requirements.
