Explanatory Note

These regulations, made under enabling powers

in the recently amended Aerial Ropeways (Safety)

Ordinance, revise the penalties for most offences under

the existing regulations, and add a daily penalty where

appropriate. The opportunity has been taken to make

several other minor amendments.

Regulations 2, 5 and 6 make minor drafting

changes consequent upon changes to the principal

Ordinance.

Regulations 3, 4 and 8 are intended, in the

light of practical experience since the regulations were

made in 1977, to make certain operational requirements

more flexible.

Regulation 7 amends existing regulation 20 to

provide that the onus of ensuring that reports of

required examinations of the ropeway are sent to the

Director is upon the owner of the ropeway, rather than

upon the person making the report.

Regulations 9 and 10 revoke and replace Part

VIII of the regulations and provide for the new penalties

which are set out in the Third Schedule.

The new penalties in most cases where safety

is directly involved are substantially higher,

particularly for the owner of a ropeway.

In addition

the owner is made liable for breaches of the regulations

by his employees, unless he has taken reasonable

precautions to prevent such breaches.
