LIABILITY IN RESPECT OF CARRIAGE OF NUCLEAR MATERIAL FROM THE UK TO THE PRC (NOT BEING A PARIS CONVENTION PARTY)
(a) Under the Nuclear Installations (Hong Kong) Order 1972
(S.I. 1972/126) the person on whose behalf nuclear material is being carried within the territorial limits of Hong Kong (ie including its territorial waters) is liable for any injury or damge in Hong Kong caused by an occurance involving the material.
(b) The transporter of nuclear material from a nuclear
installation in the UK to a Non Contracting State will be liable for any injury or damage in another Contracting State caused by an occurence involving the material outside the territory of that State (eg on the High Seas) and prior to its unloading in the territory of the Non Contracting State.
In both cases HMG could be liable to pay compensation where damage exceeded 5m European Monetary Agreement Units of Account.
