Mr. D. YAP said that the granting of ex-gratia payment was by itself an indication of Govt's recognition of the unfaimess of the resumption system. He pointed out that land affected by the oversailing cables lost their development potential value.

Replying to Mr. HO Sun-kuen's question on the authority on compensation SNT said that the policy secretary for land and compensation regarding land was the Secretary for the Environment, but that the policy and rates of compensation was decided by ExCo and the Finance Committee of LegCo. As in any other country, no one civil servant alone could made such decision. Mr. Charles YUNG suggested that in view of the complexity, the system should be streamlined and that the NT should also be the policy secretary for NT matters.

SNT said that upon receipt of the letter from the Kuk on the issue of compensation in respect of the Electricity Networks (Statutory Basement Ordinance) he would consider the points raised.
