Nothing in either Order affects in any way any other statutory or legal provision which prohibits or restricts the sale or supply of any goods to Iran (for example a computer will continue to require a licence under legislation already in force). Nor does the possession of a licence under such legislation affect the prohibition on exports imposed by the new Orders; unless an exporter can satisfy the exemptions provided for in the new Orders an existing licence cannot be used.
EXISTING
CONTRACTS: Exempted from the prohibitions are goods exported under contracts entered into before the date on which the Orders come into effect (30 May 1980). This exemption also applies where such a contract has been modified, amplified or extended following the date of the Orders.
Some exports to Iran are made under various commercial arrangements, such as framework and joint venture arrangements reflecting long standing and regular business commitments. The Orders provide that references
to contracts made before the date on which the Orders came into operation include new contracts for sale or supply made in continuation of an established course of business dealing between the same parties, relating to goods of the same or similar class, and which existed immediately before that date.
TRANSPORT O F
GOODS: The Iran (Trading Sanctions) Order prohibits contracts made after the date of the Order for the transport of embargoed goods to Iran by land, sea or air from the UK or any territory to which the Order applies.
PROCEDURE: Exporters wishing to ship foodstuffs or medical products to Iran falling within the descriptions set out in Part I of Schedule I in each Order should enter the goods with Customs & Excise on form C273 in the normal way.
Exporters wishing to ship any other goods to Iran (including products falling within the descriptions set out in Part II of Schedule I in each Order where these products are sold or supplied solely or mainly for medical or surgical purposes) must pre-enter the details with Customs on form C63A. Exporters must ensure that pre-entry documents contain the following declaration:
"It is hereby declared that the goods referred to in this entry for consignment to Iran are not prohibited to be exported by virtue of the Iran (Trading Sanctions) Order 1980 or the Export of Goods (Control) (Iran Sanctions) Order 1980."
Exporters may be required by the Department of Trade to furnish full documentary evidence to support their declarations.
