The purpose of this subsection is to provide a further line of defence against the unilateral imposition by other countries of their domestic economic policies on United Kingdom persons. The provision is most likely to be used where an overseas country seeks to circumvent the prohibition on enforcement in the United Kingdom of multiple damage judgments by the enactment or use of legislation in a different form but with the same purpose.

Subsection (5) provides that the Secretary of State's power to make orders under subsection (4) specifying competition provisions or rules of law in other countries for the purposes of the prohibition in subsection (2)(b) shall be exerciseable by statutory instrument subject to annulment in pursuance of a resolution of either House of Parliament.

Subsection (6) provides that the prohibition in subsection (2) on enforcement of judgments given by courts of overseas countries applies to any judgment for multiple damages whether given before or after the date of passage of the Bill, unless before that date either a judgment has been registered under the provisions specified in subsection (1) or proceedings for its enforcement

have been finally determined.
