Your confidential savingram No. 71 of 12th January,

Council of Europe Convention of Human Rights.

I have considered the special circumstances in Hong Kong which relate to the extension of this Convention, as described in your savingram under reference. As the terms of the Colonial Application Clause in the Convention require only that those territories which wish for extension should be named, and does not involve listing those territories which have not accepted extension, prime facie no public statement oono erning the application of the Convention to Hong Kong is required at this stage. Such a statement is therefore only likely to berequired if I am questioned on this subject.

In the circumstances I agree that you should proceed as proposed in paragraph 4 of your savingram under reference. I shall not in the meantime take any steps to have the provisions of the Convention extended to Hong Kong.
