There are thus two bodies empowered to take decisions under the system set up by the Convention a judicial au- thority, the European Court of Human Rights, and a political authority, the Committee of Ministers of the Council of Europe.

While the Convention was under negotiation in 1950, there was a divergence of views as to whether a Court of Human Rights should be set up at all. As a result, the juris- diction of the Court was made optional, and the Committee of Ministers takes a decision if the case is not sent to the Court.
