18. DISMISSAL OR PUNISHMENT FOR MISCONDUCT, ETC.
(i) An officer is liable to disciplinary punishment (including
dismissal) if he neglects or wilfully refuses to perform his duties or in any manner misconducts himself.
(ii) Upon dismissal, an officer forfeits all rights, privileges
and terminal benefits of office.
(iii) It is to be particularly noted that an officer who is
dismissed will thereupon cease to be eligible for passage to his country of origin.
(iv) Upon dismissal, an officer on agreement shall be liable to
repay on demand to the Government that croportion of the cost of passages to Hong Kong (including associated baggage and travelling expenses) provided in that tour for himself and his family which the uncompleted portion of the full tour bears to the full tour, and the outstanding balance of any recoverable advances of salary which he may have received.
19. DEATH OF OFFICER
(i)
If an officer dies in service, his family will be granted
Such passages are passages to his country of origin. available for six months after the date of the officer's death.
(ii) The estate of such an officer will be paid, ex-gratia,

sum equivalent to the salary (and gratuity in the case of an officer on agreement) payable at the time of his death in respect of his outstanding earned vacation leave balance provided there are no particular reasons for witholding such a concession (for example, the officer may be under notice of termination). Such payment will not attract Salaries Tax or Estate Duty in Hong Kong.
20. GRATUITY/RESETTLEMENT GRANT
(i)
(officers on agreement only)(*For teachers)
On satisfactory completion of the tour of service required by this Memorandum or if the officer's services are terminated under Section 17 of this Memorandum for reasons other than misconduct, the officer will receive a gratuity/resettlement grant for the period of service, including periods of earned vacation leave and the period of the direct journey to Hong Kong on first appointment. Such gratuity/resettlement grant will be payable in the form of a percentage of total basic salary of substantive office (plus expatriation pay where appropriate) drawn during the respective agreement period, at the rate of 25 per cent.
