Thank you for your further letter of 13th September concerning Mrs. Penhearow.
While I have every sympathy with Mrs. Penhearow, I think we have done everything we can do to assist her. I therefore cannot accept, in all the circumstances of this case, that she should be recompensed for any loss she may have incurred from fluctuations in exchange rates.

I am advised by the Commissioner of Inland Revenue that the refund referred to in my earlier letter arose from a technical taxation matter to which, under the confidentiality of the Inland Revenue Ordinance, I am not privy; it did not spring from a simple or straightforward over-assessment of her husband's salaries tax. I did not suggest that Mrs. Penhearow should be thought to be content with the latest refund: I merely hoped that in the light of what I had told you it would be agreed that we have satisfactorily resolved the matter and that she would accept the explanation given by the Commissioner of Inland Revenue.
Finally, to complete the picture I should add that before her departure Mrs. Penhearow was advised orally that it might take some time to clear the account of her husband if outstanding payments had to be deducted from sums due to the estate, and she was asked if she would like to accept an advanced under CSR 625. Unfortunately, she declined the offer. Beyond this, the fact remains that the sums payable were due to Mrs. Penhearow in Hong Kong Dollars, and we cannot accept responsibility for relative fluctuations between two different exchange rates.
