TUNG -V- LORD GORONWY ROBERTS AND DR. DAVID OWEN

I am writing to let you know that Mr. Tung's appeal from the

Order of Master Elton herein dated 18th June, came before Mr. Justice

Neill on Friday last, when after a hearing lasting just over an hour it

was dismissed. In the circumstances, I, again, did not ask for costs.

Although Mr. Tung did not ask for leave to appeal to the Court

of Appeal technically it is still open to him to go back to the Judge for

this purpose.

If, as I suspect, the Judge refuses him leave he can then

apply for leave to the Court of Appeal directly. Whether Mr. Tung will

take matters so far I cannot say at this stage but I will keep you posted

as to developments.
