Thank you for your letter of 31 July 1979.

It is unfortunate that the Germans should hide behind UK immigration lagislation and particularly *returnability' which has never been in question, so fær as HK passports are concerned.

We quite understand that they do not want UC passport holders to be stranded in Germany because they belong neither to the UK nor to my other territory, Bart this is not the case with Hong Kong. It is a cornerstone of our policy that we accept back 'moonditionally all holders of Hong Kong passportB. This guarantee extends also to holders of HK passports who, for whatever reason, acquire a UK passport from a passport office in the UK or from a British Consulate overseas, and who obtain a 'right to land' endorsement for Hong Kong.

I have consulted Iain Orr, the noting Political Adviser, and we agree that the case should be put to the Germans, as rehearsed by Bonn. I should be grateful if you would ask the mbassy to proceed accordingly.
