MEMORANDUM FOR EXECUTIVE COUNCIL

IMMIGRATION FROM CHINA

With effect from 1st January 1979, it is proposed to alter the existing administrative arrangements for the admission of immigrants from China by:

(a) abolishing the distinction between residents of Kwangtung and residents from elsewhere in China;

(b)

limiting the initial stay of all legal new arrivals from China in accordance with the validity of the Chinese travel document or to 12 months, whichever is the less; and

limiting the initial stay of all illegal new arrivals from China to 3 months.

The effect of these changes is that most immigrants will be admitted for three months in the first instance, Thereafter they will be granted extensions of three months at a time, during the first year, and thereafter extensions of 12 months...

The current procedures are as follows:

residents of Kwangtung province are allowed unconditional stay, regardless of the purpose or proposed length of stay;

residents from elsewhere in China whose destination is Hong Kong are allowed a 12 months stay, regardless of purpose or proposed length of stay;

illegal immigrants from China who register for identity cards are also granted an initial stay of 12 months when their status is legalised; and

in categories (b) and (c) extensions of stay of 12 months are granted on request until after

7 years when the status of "Chinese resident

with unconditional stay" is reached.
