The Working Group recalls its earlier observation (in paragraph 2.1(e) above) that although prohibition ageinst termination of employment is in line with the spirit of I10 Conventions and with the laws of our neighbouri Asian countries, the rescdial provisions for breach

of the lay are insufficient as a deterrent and need to be strengthened. The Working Group recomiends that breach of ection 15(1) should be

nade a prosecutable offence as is the case at present with breaches of other sections in the Duploy ent Crdinance (e.g. sickness allowance, pic annu-l leave). The Working Group further recommends that the lar should he ended so that for the first two surviving children a fumale o ployee would be entitled to full raternity benefits for the whole of her maternity period if she is dismissed before the expiry of her laternity leave, and that exinting Section 15(2)hould apply in the case of subsequent pregnancies for which the e ployee would be entitled to unpaid naternity leave.

Paternity leave

3.15

The orking Group does not support the Hong Kong Chris- tian Industrial Crittee's proposal of one week paternity leave at 2/3 rages around the time of the wife's confinement, which strictly falls outside its ter is of reference. In any case it observes that countries in at or South-east Asia, the United Kingdon and ILC

Conventions do not provia for such a benefit.
