Amendment of section 5.

5.

REGISTRATION OF PERSONS (AMENDMENT) (NO. 2)

admissible in evidence in criminal or civil proceedings before any court on its production without further proof and-

(a) until the contrary is proved, the court before which

such document is produced shall presume-

(i) that the document is certified by such officer; and

(ii) that the document is a true copy of the records or part of the records to which it refers; and

(b) such document shall be prima facie evidence of all

matters contained therein.”.

Section 5 of the principal Ordinance is amended-

(a) in paragraph (a) by deleting "by which he elected to be

registered;" and substituting the following—

"entered on the identity card issued to such person;"; and

(b) in paragraph (c)(i) by deleting "by which such other person

elected to be registered" and substituting the following-

"entered on the identity card issued to such other person”.

Section 7 of the principal Ordinance is amended-

(a) in subsection (3) by deleting "one thousand dollars and imprison-

ment for six months" and substituting the following-

“$5 000 and imprisonment for 2 years"; and

(b) by inserting after subsection (3) the following--

(Cap. 227.)

"(4) Any regulation made under this Ordinance may provide that, notwithstanding section 26 of the Magistrates Ordinance, criminal proceedings in respect of any such offence under the regulations as may be specified therein may be instituted within such period, not exceeding 3 years. of the commission of the offence as may be so specified.".

An Ordinance to amend the Births and Deaths Registration Ordinance.

[20th July, 1979]

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Births and Deaths Registra- Short title, tion (Amendment) Ordinance 1979.

2.

Section 13 of the principal Ordinance is amended-

Amendment of section 13.

(a) in subsection (1) by deleting "In" and substituting the following→ (Cap. 174.)

"Subject to subsection (3A), in"; and

(b) by inserting after subsection (3) the following subsection-

“(3A) No alteration or addition to the name or names of a child, in any register book of births, shall be made under this section after the child has attained the age of 11 years.".
