of which an offence under
paragraph (1)(b) or (c) or
regulation 12(1) or (2) has
been committed,
he may, whether or not any person is to
be prosecuted for the offence, cancel
such card and order it to be surrendered
to a registration officer and may order
the person whose name is entered on such
card to apply for a new identity card
in such manner and within such time
as he may require.
(4) Any person who fails or refuses
to comply with any order under paragraph
(3) shall be guilty of an offence and
liable to a fine of $5 000 and to
imprisonment for 2 years.
(5) Notwithstanding section 26 of
the Magistrates Ordinance, criminal
proceedings in respect of -
(a)
an offence under paragraph (1)(a)
by reason of the contravention
of regulation 3, 6 or 18 may be
