57C. In sections 57A and 57B "member of Her Majesty's forces" includes any officer or member of the Royal Hong Kong Regiment as constituted under the Royal Hong Kong Regiment Ordinance or of the Royal Hong Kong Auxiliary Air Force as constituted under the Royal Hong Kong Auxiliary Air Force Ordinance.".

Section 58 of the principal Ordinance is amended--

(a) in subsection (1)—–—

(i) by inserting after "ships of war" the following-

"or auxiliary ships"; and

(ii) by deleting "not exceeding 500 gross tons and"; and

(b) in subsection (2)—

(i) by inserting after "ships of war" the following—

"or auxiliary ships"; and

(ii) by deleting "not exceeding 500 gross tons".

An Ordinance to provide for the restriction for a limited period of build-

ing works in the Mid-levels area of Hong Kong.

[22nd May, 1979]

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Temporary Restriction of Short title and Building Development (Mid-levels) Ordinance 1979 and shall be deemed commencement. to have come into operation at 12 noon on 22 May 1979.

2. (1) In this Ordinance, unless the context otherwise requires Interpretation.

"Building Authority" means the Director of Public Works;

"building plans" means plans of building works for or involving site formation, excavations, foundations, street works or any works relat- ing thereto.

(2) The duty imposed on the Building Authority under this Ordinance may be carried out by any officer of the Public Works Department authorized by the Director of Public Works either generally or partic- ularly and subject to his instructions.

3. (1) Without prejudice to section 14 or 16 of the Buildings Building Ordinance, the Building Authority shall, unless the Governor otherwise Authority to directs in any particular case, refuse to give—

(a) his approval of any building plans submitted to him for his building plans.

(b) his consent for the commencement of any building works for or involving site formation, excavations, foundations, street works

or any works relating thereto, whether his consent was applied for before or after 12 noon on 22 May 1979,

if the building works are to be carried out wholly or partly in the area specified in the Schedule.

(2) Where the Governor gives directions to the Building Authority to approve building plans or to consent to the commencement of building works for the purposes of section 14 of the Buildings Ordinance, he may require the Building Authority to make the approval or consent subject to such conditions as the Governor considers necessary in the public interest.
