LABOUR TRIBUNAL (AMENDMENT) ORDINANCE 1979

This Ordinance extends the time for filing claims in the Labour Tribunal from 6 months to 12 months from the date of the cause of action. The object is to allow some types of claim (commonly involving arrears of wages, leave pay or bonuses) that tended to run foul of the short 6 month limitation period. The amendment does not expand the categories of claim which may be brought before the tribunal and is to ensure that, as far as possible, and without sacrificing the principle of simple and swift justice, those claims are dealt with by the most appropriate tribunal.

The transitional provisions in section 3 are designed to prevent the extended time limit from applying to claims already barred at the commencement of this Ordinance. This will not affect the provision contained in the principal Ordinance prior to commencement of this Ordinance, enabling the time limit for filing claims to be extended by agreement of the parties.

Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, I advised that he could properly do so.
