AIR TRAFFIC RIGHTS LONDON/HONG KONG: A FAIR DEAL FOR CPA

1. I submit a draft reply to Mr Steele's letter of 18 June

to Mr Cortazzi.

Hong Kong and General Department agree.

2. I attach a copy of the Civil Aviation Act 1971, which

contains a number of provisions for the Secretary of State for

Trade to issue directions to the CAA. See in particular Section

4.3(b). The bias against a non-British airline, which is defined include in a way that must exclude CPA, is in Section 3. I also attach

the earlier exchange of letters between Mr Steele and Mr Cortazzi.

3. We suggested to Mr Steele that the draft telegram should

also tell the Hong Kong Government to make sure CPA realized that

it was up to the airline to put in an application if they wanted

(as we assume) to get on the London route. But Mr Steele said

that he had already spoken to CPA and did not want the point

included.
