U.K ROUTE 2. SUBJECT TO PARAGRAPH 2 BELOW, IF YOU ARE DETERMINED TO INCLUDE THE REGIONAL ROUTES IN THE ANNEX, THEN WE FEEL THAT SHANGHAI AND PEKING SHOULD BE INCLUDED IN COLUMN 2 BEFORE THE REFERENCE TO OTHER POINTS IN CHINA (OUR TELNO.471).

ANNEX (11). WE ARE AWARE THAT THE REFERENCE TO SPECIAL FLIGHTS AND CHARTER FLIGHTS WERE INCLUDED IN THE ASA INITIALED IN 1973 AT THE SPECIFIC REQUEST OF THE CHINESE. HOWEVER, CAAC ARE NOW MUCH MORE FAMILIAR WITH THE TECHNICALITIES OF AIR SERVICES. IT IS THEREFORE DISAPPOINTING THAT THE OPPORTUNITY
HAS NOT BEEN TAKEN TO EXCLUDE SUCH REFERENCE IN THE NEW DRAFT, SINCE CHARTER FLIGHTS ARE ADEQUATELY PROVIDED FOR IN BOTH H.M.G AND H.K.G LEGISLATION. WE RECOMMEND THAT THE PARAGRAPH BE DELETED FROM THE DRAFT.
2. OUR VIEW WITH REGARD TO THE REGIONAL SERVICES REMAINS THAT THIS POINT SHOULD BE COVERED BY A SIDE LETTER OUTSIDE THE ASA. WE ARE MUCH CONCERNED THAT INCLUDING DETAILS ABOUT REGIONAL SERVICES IN THE AGREEMENT ITSELF WILL RESULT IN JUST THE KIND OF WRANGLES OVER THE STATUS OF HONG KONG THAT WE FEAR AND MIGHT EVEN CAUSE THE CHINESE TO SHY AWAY FROM TALKS INDEFINITELY WHICH WOULD NOT BE IN
OUR INTEREST.
