Proposed Grant of Crown Lease for 999 years under the Foreshores and Sea Bed Ordinance
(Chapter 127) of the Laws of Hong Kong
Kowloon Marine Lot 11 is held under a Crown lease dated 12th March, 1910 for a term of 999 years commencing from 13th September, 1881. The registered Crown lessee is the Hong Kong and Kowloon Wharf and Godown Company Limited. The lot has been carved out
into S.A, S.B, S.C and R.P. with S.A vested in Ocean Centre Limited, S.B in Harbour City Limited and the two remaining sections in the Hong Kong and Kowloon Wharf and Godown Company Limited.

The Hong Kong and Kowloon Wharf and Godown Company Limited has recently asked for the grant of an adjacent piece of seabed 40 m x 40 m under the Foreshores and Sea Bed Ordinance to construct a sea water pumping station to provide
(a)
sea water cooling for air conditioning water chillers in main plant room of Harbour City Development;

(b)
flushing water for the entire Harbour City Development;
(c)
(a)
primary water source for fire fighting in Harbour City Development; and
emergency supplies of sea water to Ocean Centre Development when their intakes are unserviceable.
It has been accepted that the lease term in respect of this sea water pumping station should be the same as K.M.L. 11, i.e., 999 years commencing from 13th September, 1881. However, in view of the provision of section 3 of the Foreshores and Sea Bed Ordinance which reads -
*Subject to the provisions of this Ordinance,
the Governor may grant and agree to grant such Crown leases for any term not exceeding 99 years (renewable on the usual terms), or
